Man dies after being washed off harbour wall in Ramsgate



A man has died after being washed off a harbour wall in Ramsgate, emergency services have said.

The death comes as parts of Britain were hit by strong winds and heavy rain, with dozens of flood alerts also issued.

Kent Police were called to Royal Harbour at around 11.30am after reports that there were three people in the water.

Margate Coastguard Rescue Team, the Ramsgate RNLI lifeboats and South East Ambulance Service were also sent to the scene.

A spokeswoman for the Maritime and Coastguard Agency said: “It is believed that all three people were washed off the pier by a large wave.”

Ramsgate lifeboat station said in a post on Facebook that they were called to reports that three people had been “washed off the harbour wall”.

Two were pulled from the water, and a third was found clinging to the harbour wall with injuries.

One of the men died at the scene.

Weather conditions in Ramsgate were described as “atrocious” by the RNLI, with waves reportedly breaking over the harbour wall following a combination of a spring tide and strong winds.

Police said the death is not being treated as suspicious and they are still trying to find the man’s next of kin.

The other two men were taken to hospital, where they are still being treated.

Nearly 40 “be prepared” flood alerts were active on Monday afternoon, most of them for south east England.

Temperatures have plummeted, trees have fallen across roads, and up to 57.6mm of rain has been recorded in parts of the southeast.

A family of two adults and a baby had to be rescued by Kent Fire and Rescue Service after their car became stuck in flood water in Sutton Valence.

Two drivers were also helped from flood water in Dover.

Juror says Bill Cosby’s own deposition convinced him he was guilty



The following exchanges between Cosby and Constand lawyer Dolores Troiani took place in 2005 and 2006. They are excerpted for brevity and to delete legal squabbling and repetition. 

[On Andrea Constand]

Q. When did you first develop a romantic interest in Andrea?

A. Probably the first time I saw her (at Temple’s arena).

[On the night in question]

Q: Can you tell me … what you recall of the night in which you gave the pills to Andrea?

A: Andrea came to the house. I called her. … We talked about Temple University. We talked about her position. And then I went upstairs and I got three pills. I brought them down. They are the equivalent of one and a half. The reason why I gave them and offered them to Andrea, which she took after examining them, was because she was talking about stress.

[Cosby describes a several-minute sexual encounter that followed.]

Q: So, you’re not telling us that you verbally asked her for permission?

A: I didn’t say it verbally, I said. The action is my hand on her midriff, which is skin. I’m not lifting any clothing up. This is, I don’t remember fully what it is, but it’s there and I can feel. I got her skin and it’s just above the hand and it’s just above where you can go under the pants.

Q: Then what happens?

A: I don’t hear her say anything. And I don’t feel her say anything. And so I continue and I go into the area that is somewhere between permission and rejection. I am not stopped.

[Troiani asks Cosby about a phone call a year later between Cosby and Constand’s mother, Gianni Constand, who told him something was wrong with her daughter, who was also on the line.]

Q: What was the thing that you did not want to talk about?

A: I didn’t want to talk about, ‘What did you give her?’

Q: Why?

A: Because we’re over the telephone and I’m not sending anything [the pill bottle] over the mail and I’m not giving away anything.

Q: Why didn’t you simply tell her … that you had given her daughter an over-the-counter drug called Benadryl?

A: I’m not going to argue with somebody’s mother who is accusing me of something. And then when I apologize she says to me, ‘That’s all I wanted to know, Bill.’ … And I’m apologizing because I’m thinking this is a dirty old man with a young girl. I apologized. I said to the mother it was digital penetration.

Q: When she sat here and cried (Constand, during her deposition), how did you feel?

A: I think Andrea is a liar and I know she’s a liar because I was there. 

[Cosby testified that he had gotten quaaludes from his doctor in Los Angeles in the 1970s. He said he was given seven prescriptions for the now-banned sedative, ostensibly for a sore back.]

Q: Why didn’t you ever take the quaaludes?

A: Because I used them.

Q: For what?

A: The same as a person would say, ‘Have a drink.’

Q: You gave them to other people?

A: Yes.

Q: Did you believe at that time that it was illegal for you to dispense those drugs?

A: Yes.

 Q: Why didn’t you ever take the quaaludes? A: Because I used them. Q: For what? A: The same as a person would say, ‘Have a drink.’

Q: How did [the doctor] know that you didn’t plan to use [them]?

A: What was happening at that time was that, that was, quaaludes happen to be the drug that kids, young people were using to party with and there were times when I wanted to have them just in case.

Q: When you got the quaaludes, was it in your mind that you were going to use these quaaludes for young women that you wanted to have sex with?

A. Yes.

[Cosby acknowledges having a sexual relationship with accuser Therese (Picking) Serignese starting around 1976, when she was 19. Serignese, who has gone public with her accusations, has said the first time she met Cosby at a Las Vegas hotel in 1976, he gave her quaaludes and a glass of water before they had sex.]

Q: Did you give her quaaludes?

A: Yes.

Q: What effect did the quaaludes have on her?

A: She became in those days what was called high.

Q: She said that she believes she was not in the position to consent to intercourse after you gave her the drug. Do you believe that is correct?

A: I don’t know. … How many years ago are we talking about? 197(6)? … I meet Ms. Picking in Las Vegas. She meets me backstage. I give her quaaludes. We then have sex. 

Q: Why didn’t you ever take them yourself?

A: I get sleepy.

Q: How would you know that if you never took them?

A: Quaaludes happen to be a depressant. I have had surgery and while being given pills that block the nervous system, in particular the areas of muscle, the back, I found that I get sleepy and I want to stay awake.

Q: Is that why you don’t drink alcohol?

A: Exactly.

[Cosby says that while he was filming one of his sitcoms, a modeling agency would send ‘five or six’ models to his studio each week. He says he would give the struggling, young actresses ‘a very, very good meal.’ He describes a sexual encounter he had with one of them in 2000.]

Q: She says that just days after … she told you that she did not drink, you told her to come over to [your townhouse] and served her amaretto. Do you recall serving her amaretto?

A: No.

Q: That you told her to sit next to you on the couch and that you put your arm around her and began massaging her shoulder and arms suggestively. Did that occur? … This occurred sometime after you met her parents.

A: I need clarification on time.

Q: She’s 17 and I believe throughout the time she knows you she becomes 18 or 19.

Q: On a later occasion you had her masturbate you with lotion. Did that ever happen?

A: Yes.

Q: (She) used the lotion to rub your penis and make you ejaculate?

A: Bingo.

[Cosby is also asked about a young actress who filed a complaint with New York police that never led to charges. She is named in the deposition but has not gone public with her account and has not returned messages left with family members over the past year. The AP does not identify sexual-assault accusers without their consent]

Q: Do you recall saying that you had threatened to sue the National Enquirer for printing [her] story?

A: Yes.

Q: Do you remember how old she was when she worked on the television show?

A: About 19.

Q: Did you ever develop a romantic interest in [her]?

A: Yes. …. I called her, talked to her.

Q: What did you talk about?

A: I believe, this has been a long time, her twin sister, her brother, their education.

Q: What did you tell her was the reason why you were inviting her into the house?

A: Her career.

[On the 19-year-old’s second visit]

A: I fed her dinner, gave her three drinks. We went then to the living room. We went through acting, elementary moves. We then went to the sofa. We laid down together. I was behind her.

 She said that she believes she was not in the position to consent to intercourse after you gave her the drug. Do you believe that is correct? A: I don’t know.

Q: Was she lying down or sitting up?

A: No, she was down.

Q: Did she fall asleep?

A: Yes.

Q: What did you do when she fell asleep?

A: I got up.

Q: Did you engage in any type of sexual contact with her while you were on the couch?

A: No.

Q. Are you aware that the woman’s statement was that on the night of the dinner at your New York townhouse, ‘At some point Cosby and the woman were sitting on a sofa and Cosby was massaging her back?’

A: Yes.

Q: ‘Cosby then lowered his pants in an effort to receive oral sex?’

A: ‘In an effort to receive oral sex,’ that did not happen.

Q: ‘The woman rebuffed Cosby’s advances and was immediately sent home, driven by Cosby’s driver?’

A: And that is not true. 

[Cosby is asked about educational trusts he offered Constand and others, through his foundation or otherwise.]

Q: How would [the money to Constand] come?

A: It would come through our writing a check.

Q: And our being who?

A: The family.

 Q:Was [this] to disguise that you were paying money to Therese? A: Yes. Q: Who were you preventing from knowing that? A: Mrs. Cosby.

Q: Would your wife know about that?

A: My wife would not know it was because Andrea and I had had sex and that Andrea was now very, very upset and that she decided that she would like to go to school or whatever.

Q: How would you explain to your wife that you were giving this personally as opposed to using the foundation?

A: I would say to her that there is a person I would like to help.

[In paying Therese Serignese, Cosby acknowledges the money would flow through his representatives at the William Morris agency.]

Q: So, was the purpose of that to disguise –

A: Yes.

Q: I have to finish my question. Was [this] to disguise that you were paying money to Therese?

A: Yes.

Q: Who were you preventing from knowing that?

A: Mrs. Cosby.

[Cosby was asked by Constand’s lawyer about granting an exclusive interview to the National Enquirer in 2005 in exchange for the tabloid agreeing not to publish a story about accuser Beth Ferrier, who has gone public as another accuser attached to Constand’s lawsuit.]

Q: What is your understanding of the agreement that you had with the National Enquirer?

A: I would give them an exclusive story, my words.

 Q: So that you knew when [your] article was printed … that you had to make the public believe that Andrea was not telling the truth? A: Yes.

Q: What would they give you in return?

A: They would not print … Beth’s story.

Q: Did you ever think that if Beth Ferrier’s story was printed in the National Enquirer that would make the public believe that maybe Andrea (Constand) was also telling the truth?

A: Exactly.

Q: So that you knew when [your] article was printed … that you had to make the public believe that Andrea was not telling the truth?

A: Yes.

Lynn thrilled to find form at crunch time



Cape Town – Australia batsman Chris Lynn is thrilled that his batting
form has picked up after a slow start to the Indian Premier League for the
Kolkata Knight Riders

Lynn has struggled for fluency in a team that hasn’t fired
consistently despite bagging decent results so far and remaining in contention
for a playoff spot. 

The aggressive top order man hit an unbeaten fifty to see
KKR past the Royal Challengers in Bengalaru on Sunday and feels that he is
coming good having just returned from the latest in a string of injuries. 

Lynn said after the match: “It hasn’t been as free-flowing
as I’d normally like. Obviously come off the back of a couple of injuries so I
haven’t exactly hit the ground running. 

“Maybe my body didn’t allow that early on but it’s
coming good now. I’m starting to find a bit of momentum, which is important
coming into the back end of the tournament. 

Lynn made liberal use of a much-improved sweep shot to
counteract spinners who have been effective in limiting the damage the
big-hitter has been able to do in the powerplay thus far in IPL 2018. 

He added: “Obviously they have a couple of quality spinners
[Yuzvendra Chahal and Murugan Ashwin] and we saw the ball turning. We had to
really grind our way out there. It wasn’t your typical Twenty20 game of cricket
with the ball flying around. 

“We had to find a way, and for me it was sweep shots,
get down the other end. It was challenging and the boys … we had one bloke at
one end anchoring the innings – guys coming in like Robbie (Robin Uthappa) and
DK (Dinesh Karthik, the captain), playing crucial knocks.” 

Lynn was happy to do a job for his team who needed to pick
up a win having suffered back to back defeats after a strong start to the
campaign. 

He continued: “Nights like tonight and wickets like tonight,

Theresa May did not know about the deportation targets for illegal immigrants which brought down Amber Rudd, a Cabinet colleague has suggested.

Chris Grayling sought to deflect Labour demands for the prime minister to set out her knowledge of the controversy – and whether she knew the departing home secretary had misled parliament.

The transport secretary said Ms May would not – as Labour wants – take Ms Rudd’s place in the Commons later today to answer questions in her place.

And, asked if she had known that Ms Rudd’s denials about targets were “not true”, he replied: “The current prime minister has not been home secretary for an extensive period.

“She will not know exactly what is happening in the home office today.”

Diane Abbott is leading calls for the prime minister to face MPs today, saying: “All roads lead back to Theresa May and her tenure as home secretary.”

Ms Rudd quit late on Sunday, after realising her defence that she had not known about the targets would not withstand a fresh barrage of criticism in the Commons.

An audit of documents is believed to have thrown up several memos to her discussing targets for 2018-19 – including one she wrote to Ms May, setting out her intention to increase deportations by 10 per cent.

The revelation has sharpened the focus on the role of the prime minister, the architect of the “hostile environment” policy that ended up persecuting the Windrush generation.

Crucially, it is believed that any members of the Windrush generation detained for deportation – or prevented from returning to the UK – would have counted towards the now-revealed forced removal target.

Ms Abbott told the BBC: “We all need to turn our attention to Theresa May because it was in her tenure as home secretary that many of the worst aspects of the so-called hostile climate were pushed through.”

Specifically, the prime minister should answer questions in the Commons about her knowledge of migrant removal targets, the shadow home secretary said.

“We want to talk to her about the aspects of the so-called hostile environment which she was responsible for and led to the Windrush fiasco,” she added.

Speaking to BBC Radio 4’s Today programme, Mr Grayling dismissed calls for an inquiry into the Windrush scandal, arguing it was wrong to “delay or distract” from government efforts to help them.

And he rejected an appearance by Ms May today, saying: “She is going to be back in the House of Commons on Wednesday. The opposition will have an opportunity to question her then.”

Asked if home office officials had been “carrying out wishes” in targeting the Windrush generation for removal, Mr Grayling insisted it was “the system” which had failed.

Rajasthan Royals’ desire to move up the pecking order got a boost following an incredible win a week ago, and the mid-table team would look to keep the momentum going in its IPL game against Sunrisers Hyderabad in Jaipur on Sunday.

The Royals are aware of the challenges facing them at the Sawai Mansingh Stadum, a few days after Sunrisers Hyderabad got the better of Kings XI Punjab to grab the second position in the standings.

While SRH have won five out of their seven games so far, Rajasthan Royals are placed fifth with three victories and as many losses.

 

Rajasthan were on their way to suffer back-to-back defeats before a superb cameo from all-rounder Krishnappa Gowtham helped them stun Mumbai Indians by three wickets last Sunday.

The hosts are looking forward to skipper Ajinkya Rahane to lead them by example, and the India Test vice-captain must be eager to live up to the expectations.

With his explosive hitting, the immensely talented Sanju Samson is turning out to be RR’s batting mainstay, and another big one could be in the offing.

Samson is high on confidence having played a few significant knocks so far in the cash-rich league.

The English duo of Ben Stokes and Jos Buttler add muscle to Rajasthan’s batting, and they are always keen to have a good hit in the middle.

It may be an away game for them but Sunrisers Hyderabad will still fancy their chances.

Despite losing their skipper David Warner as a result of the one-year ban imposed on the Australian run-machine due to ball tampering, Sunrisers Hyderabad showed tremendous fighting abilities and the very impressive win ratio is proof of that.

While revenge may on RR’s mid having lost the first leg game by nine wickets, the home team will need to play out of its skin to come out winners tomorrow.

Batting lynchpin Shikhar Dhawan will look to make merry, having missed out on the previous match against KXIP.

A certain Kane Williamson is always an asset to any team while Manish Pandey’s confidence has surely gone up after what proved to be a critical half-century against KXIP.

The likes of Deepak Hooda and Yusuf Pathan add depth to their batting.

The world’s top-ranked T20 bowler, Afghanistan leg-spinner Rashid Khan has led SRH’s spin attack with some success, and they have the ever-reliable Bhuvneshwar Kumar spearhead the pace department.

A 40ft deep hole has opened up beneath a car park built on top of a disused Cornish mineshaft.

Devon and Cornwall Police rang an engineer who was then tied to the officers’ car and slithered across the tarmac to assess the enormous crater in St Ives.

The area was fenced off on Saturday and work has been underway to stop it widening and affecting nearby homes. It is currently about 3ft wide at the surface.

Jim Gallienne, of Cornwall Search and Rescue, told the BBC: ‘The hole could get deeper, but is not likely to get any wider.

‘It shouldn’t be swallowing up anything else around it any time soon.’

He said it was rare for a hole like this to open up so close to residential properties and it is not clear what type of mineshaft it is, or what it would have been used for.

Some parts of Cornwall are ‘riddled’ with mineshafts, according to mining historians.

Injecting Drugs Can Ruin a Heart. How Many Second Chances Should a User Get?


Treatment for endocarditis usually involves up to six weeks of intravenous antibiotics, often in the hospital because doctors are wary of sending addicted patients home with IV lines for fear they would use them to inject illicit drugs. Many, like Ms. Whitefield, also need intricate surgery to repair or replace damaged heart valves. The cost can easily top $150,000, Dr. Pollard said.

Advice from specialty groups, like the American Association for Thoracic Surgery and the American College of Cardiology, about when to operate remains vague. For now, “it’s just a lot of anecdote — surgeons talking to each other, trying to determine when we should and when we shouldn’t,” said Dr. Carlo Martinez, who is one of Dr. Pollard’s partners and who operated on Ms. Whitefield at Methodist Medical Center of Oak Ridge.

Their practice, owned by Covenant Health, will almost always operate on someone with a first-time case of endocarditis from injecting drugs, Dr. Pollard said. But repeat infections, when the damage can be more extensive and harder to fix, make it a tougher call. Dr. Mark Browne, Covenant’s senior vice president and chief medical officer, said, “Each patient is evaluated individually and decisions regarding the appropriate course of care are determined by their attending physician.”

In the nearly two years since she got sick, Ms. Whitefield has felt physically diminished and been prone to illness. She also feels harshly judged by a medical system that saved her life but often treats her with suspicion and disdain.

Over the same stretch of time, Dr. Pollard has grown increasingly disillusioned with hospitals that consider addiction treatment beyond their purview, and haunted by the likelihood that many of his drug-addicted patients will die young whether they get heart surgery or not. He set up a task force in 2016 to address the problem but has faced obstacles, especially concerning cost and, he believes, a societal reluctance to spend money on people who abuse drugs.

“Everybody has sympathy for babies and children,” he said. “No one wants to help the adult drug addict because the thought is they did this to themselves.”

UK weather: Flood warnings as Britain braces for torrential rain and falling temperatures


Forecasters have warned homes and businesses could face flooding as Britain braces for heavy rain and strong winds as temperatures fall.

Advice over worsening weather comes just a week after the warmest day in April in almost 70 years and the hottest London Marathon on recor.

The south-east of England is likely to “bear the brunt” of the bad weather, caused by an area of low pressure developing in France, which was expected to hit the UK at around 9pm on Sunday and last most of Monday.

Yellow weather warnings for rain have been issued for eastern, southeastern and central England until 11.59pm on Monday, and strong winds are also expected.

Weather experts warned this could lead to spray and flooding on roads, travel disruption – and even flooding of homes and businesses.

Met Office meteorologist Greg Dewhurst told the Independent: “The rain will start moving in this [Sunday] evening probably hitting Kent between 6-9pm becoming more heavy and persistent as the night goes on and lasting for most of Monday.

“Some very heavy rainfall is to come over the next 24 hours of about 30mm to 40mm – or even possibly 70mm locally – which could lead to localised flooding.

“To put it into perspective, East Anglia’s average rainfall for April is around 40mm so we are looking at that, but within 24 hours.

“It’s likely to lead to some disruption so for the morning commute it won’t be a nice drive at all.

“The southeast of England will bear the brunt of it and in terms of the effects at the moment there’s a chance there could be river flooding, road closures, and possibly even the risk of property flooding.”

Sunday is expected to be a fairly cloudy day across the whole of the UK, with a few scattered showers around but also some bright spells.

There will be highs of about 13C to 14C in the South and temperatures are expected to be around average for this time of year in other places.

It is expected to be a cold day on Monday in areas where there is rain, with highs of around 7C to 8C.

For those areas of the UK not affected by the bad weather it is likely to be generally dry and bright on Monday with temperatures of around 11C.

Facebook shrinks fake news after warnings backfire – TechCrunch


Tell someone not to do something and sometimes they just want to do it more. That’s what happened when Facebook put red flags on debunked fake news. Users who wanted to believe the false stories had their fevers ignited and they actually shared the hoaxes more. That led Facebook to ditch the incendiary red flags in favor of showing Related Articles with more level-headed perspectives from trusted news sources.

But now it’s got two more tactics to reduce the spread of misinformation, which Facebook detailed at its Fighting Abuse @Scale event in San Francisco. Facebook’s director of News Feed integrity Michael McNally and data scientist Lauren Bose held a talk discussing all the ways it intervenes. The company is trying to walk a fine line between censorship and sensibility.

These red warning labels actually backfired and made some users more likely to share, so Facebook switched to showing Related Articles

First, rather than call more attention to fake news, Facebook wants to make it easier to miss these stories while scrolling. When Facebook’s third-party fact-checkers verify an article is inaccurate, Facebook will shrink the size of the link post in the News Feed. “We reduce the visual prominence of feed stories that are fact-checked false,” a Facebook spokesperson confirmed to me.

As you can see below in the image on the left, confirmed-to-be-false news stories on mobile show up with their headline and image rolled into a single smaller row of space. Below, a Related Articles box shows “Fact-Checker”-labeled stories debunking the original link. Meanwhile on the right, a real news article’s image appears about 10 times larger, and its headline gets its own space.

 

Second, Facebook is now using machine learning to look at newly published articles and scan them for signs of falsehood. Combined with other signals like user reports, Facebook can use high falsehood prediction scores from the machine learning systems to prioritize articles in its queue for fact-checkers. That way, the fact-checkers can spend their time reviewing articles that are already qualified to probably be wrong.

“We use machine learning to help predict things that might be more likely to be false news, to help prioritize material we send to fact-checkers (given the large volume of potential material),” a spokesperson from Facebook confirmed. The social network now works with 20 fact-checkers in several countries around the world, but it’s still trying to find more to partner with. In the meantime, the machine learning will ensure their time is used efficiently.

Bose and McNally also walked the audience through Facebook’s “ecosystem” approach that fights fake news at every step of its development:

  • Account Creation – If accounts are created using fake identities or networks of bad actors, they’re removed.
  • Asset Creation – Facebook looks for similarities to shut down clusters of fraudulently created Pages and inhibit the domains they’re connected to.
  • Ad Policies – Malicious Pages and domains that exhibit signatures of wrong use lose the ability to buy or host ads, which deters them from growing their audience or monetizing it.
  • False Content Creation – Facebook applies machine learning to text and images to find patterns that indicate risk.
  • Distribution – To limit the spread of false news, Facebook works with fact-checkers. If they debunk an article, its size shrinks, Related Articles are appended and Facebook downranks the stories in News Feed.

Together, by chipping away at each phase, Facebook says it can reduce the spread of a false news story by 80 percent. Facebook needs to prove it has a handle on false news before more big elections in the U.S. and around the world arrive. There’s a lot of work to do, but Facebook has committed to hiring enough engineers and content moderators to attack the problem. And with conferences like Fighting Abuse @Scale, it can share its best practices with other tech companies so Silicon Valley can put up a united front against election interference.

While the ONE Smart Keyboard Pro doesn’t have a sweet demo tune nor can it play barking dog Jingle Bells without some help, it can teach you or your kids how to play piano. The elegant keyboard has 88 weighted keys that simulate a true mechanical piano and connects to your phone so you can learn to play at your own pace.

The Keyboard Pro costs $799 and is essentially a compact teaching keyboard. It can connect to your iOS or Android devices via an oddly shaped USB B cable and once it’s paired with the app you can run through simple songs – think Greensleeves – and more complex sheet music. This keyboard is weighted but not progressively which means that each key offers the same resistance, a consideration that might be important to some more experienced players. Further, you can connect a USB cable and connect the keyboard to your computer to use it as a MIDI controller.

Again, this is a very austere keyboard. It doesn’t do much aside from teach you how to play which, in the end, is what most of us need. Because it doesn’t have the expansive bells and whistles of a Casio and because most of the smarts are in the app itself, it’s a bit of a hard sell for most people. However, if you’re looking to learn, the ONE works.

This larger and more complete version of the One Smart Keyboard offers quality workmanship and design. The entire system is surprisingly sparse with nothing but a power button and volume on the front of the keyboard. There is an input for a sustain pedal as well as a few output jacks for headphones and that’s about it. Don’t expect to pick out instruments or pitch shift with this keyboard. Once you fire up the app you have access to teaching exercises and games that let you follow along on the LED-lit keyboard as you run through songs and scales. Finally, you can buy sheet music for $3.99 or so that you can learn to play on the ONE. There is also free sheet music available for those who want to play a little classical.

I found the entire system to be quite usable and my kids, once they figured out how to slow down the music, jumped right in learning little songs. Nothing can quite teach you how to play piano like a human teacher – there aren’t enough smarts in this app to make adjustments based on your skill – but it’s the electronic equivalent of buying a Teach Yourself Piano book and sitting down in front of grandma’s old upright. I’m especially pleased with the quality of the keyboard. I’ve already had a few MIDI keyboards over the years including models from Casio and Yamaha and this one is on par with those. The teaching feature is the main draw here, as I noted before, because there is little else you can do with this keyboard right out of the box. However, if that’s what you’re looking for in a keyboard and you don’t want to sample bodily noises so you can play Farting Clair De Lune at the school talent show, this might be the model for you.

Microsoft attempts to spin its role in counterfeiting case – TechCrunch


Earlier this week Eric Lundgren was sentenced to 15 months in prison for selling what Microsoft claimed was “counterfeit software,” but which was in fact only recovery CDs loaded with data anyone can download for free. The company has now put up a blog post setting “the facts” straight, though it’s something of a limited set of those facts.

“We are sharing this information now and responding publicly because we believe both Microsoft’s role in the case and the facts themselves are being misrepresented,” the company wrote. But it carefully avoids the deliberate misconception about software that it promulgated in court.

That misconception, which vastly overstated Lundgren’s crime and led to the sentence he received, is simply to conflate software with a license to operate that software. Without going into details (my original post spells it out at length) it maintained in court that the discs Lundgren was attempting to sell were equivalent to entire licensed operating systems, when they were simply recovery discs that any user, refurbisher, or manufacturer can download and burn for free. Lundgren was going to sell them to repair shops for a quarter each so they could hand them out to people who needed them.

Hardly anyone even makes these discs any more, certainly not Microsoft, and they’re pretty much worthless without a licensed copy of the OS in the first place. But Microsoft convinced the judges that a piece of software with no license or product key — meaning it won’t work properly, if at all — is worth the same as one with a license.

Lundgren had already pleaded guilty to infringing Dell’s trademark by copying the look of its discs, but the value Microsoft convinced the judges those discs have (a total of $700,000) directly led to his 15-month sentence.

Anyway, the company isn’t happy with the look it has of sending a guy to prison for stealing something with no value to anyone but someone with a bum computer and no backup. It summarizes what it thinks are the most important points as follows, with my commentary following the bullets.

Microsoft did not bring this case: U.S. Customs referred the case to federal prosecutors after intercepting shipments of counterfeit software imported from China by Mr. Lundgren.

This is perfectly true, however Microsoft has continually misrepresented the nature and value of the discs, falsely claiming that they led to lost sales. That’s not possible, of course, since Microsoft gives the contents of these discs away for free. It sells licenses to operate Windows, something you’d have to have already if you wanted to use the discs in the first place.

Lundgren established an elaborate counterfeit supply chain in China: Mr. Lundgren traveled extensively in China to set up a production line and designed counterfeit molds for Microsoft software in order to unlawfully manufacture counterfeit discs in significant volumes.

Microsoft is trying to make it sound like the guy is some criminal mastermind running some big time Windows pirating empire. He literally gave a Dell recovery disc to a duplication shop and told them to make exact copies of it, including the label and paper sleeve.

Lundgren failed to stop after being warned: Mr. Lundgren was even warned by a customs seizure notice that his conduct was illegal and given the opportunity to stop before he was prosecuted.

I can’t speak to this one, but Lundgren told me that the first notice he had that this was being pursued by anyone was when they raided his house. The monetary value of the discs was so small and the counterfeiting piece so minor (fake labels for duplicates of discs that Dell doesn’t even provide any more) that if anything it would be a fine and confiscation of the shipment, not a 5-year case alleging millions in damages.

Lundgren pleaded guilty: The counterfeit discs obtained by Mr. Lundgren were sold to refurbishers in the United States for his personal profit and Mr. Lundgren and his codefendant both pleaded guilty to federal felony crimes.

Lundgren pleaded guilty to counterfeiting the Dell discs, not to counterfeiting Microsoft software. It’s an important distinction because the discs are nearly worthless and copyright crimes are sentenced based on the value of the infringed item.

Lundgren went to great lengths to mislead people: His own emails submitted as evidence in the case show the lengths to which Mr. Lundgren went in an attempt to make his counterfeit software look like genuine software. They also show him directing his co-defendant to find less discerning customers who would be more easily deceived if people objected to the counterfeits.

Printing an accurate copy of a label for a disc isn’t exactly “great lengths.” Early on the company in China printed “Made in USA” on the disc and “Made in Canada” on the sleeve, and had a yellow background when it should have been green — that’s the kind of thing he was fixing.

Lundgren intended to profit from his actions: His own emails submitted as evidence before the court make clear that Mr. Lundgren’s motivation was to sell counterfeit software to generate income for himself.

The plan was to sell these nearly worthless discs —remember, anybody can make one for free — for a quarter each to refurbishers. Records, however, show that Lundgren had sold several thousand to one buyer for $3-4 each, which is contrary to this assertion. I’ve asked him for clarification on this.

Microsoft has a strong program to support legitimate refurbishers and recyclers: Our program supports hundreds of legitimate recyclers, while protecting customers.

The implication is that that Lundgren is not a legitimate refurbisher or recycler. He pointed out earlier, however, that his company, which handles recycling for Lenovo, Nintendo, and others, takes care of more e-waste in a year than Microsoft has in a decade.

When a refurbisher installs a fresh version of Windows on a refurbished PC, we charge a discounted rate of $25 for the software and a new license – it is not free.

But if they’re not installing a fresh version of Windows, because the machine already has a licensed copy on it, as so many do, the software is free. There’s no limit on how many a company can make on its own; Microsoft only charges for the licenses. Here, go make one yourself in case you need to do it.

Mr. Lundgren’s scheme was simple. He was counterfeiting Windows software in China and importing it to the United States. Mr. Lundgren intended the software to be sold to the refurbisher community as if it was a legitimate, licensed copy of Windows.

There’s the key right there. “As if it was a legitimate, licensed copy of Windows.”

These are not licensed copies of Windows! They’re discs anyone can make, and that manufacturers and refurbishers can print as many of as they like, to give to customers who already have a copy of Windows. These discs are for repairing or re-installing a copy of the OS. They did not come with licenses and Lundgren was not selling or providing licenses.

Don’t let Microsoft fool you the way they helped fool the judges. A recovery disc is something you or I or a refurbisher can make right now for free. A license to operate Windows comes from Microsoft and costs good money. They’re not the same thing and Lundgren was going to sell the former, not the latter.

I’ve asked Microsoft to explain this last point and will update the post if I hear back.

The battle for the top four in the Premier League may go to the final day after Liverpool were held to a 0-0 draw at Anfield on Saturday by Stoke City whose point may not be enough in their own scrap against relegation.

With Liverpool still to visit Chelsea, who trail them by nine points with two games in hand, Juergen Klopp’s side may have to beat Brighton & Hove Albion on May 13 and rely on their superior goal difference to qualify for the Champions League, assuming they do not secure it by winning this year’s trophy.

On paper, Saturday’s game looked a mismatch, pitting the only team unbeaten at home in England’s top four divisions against the side with the worst away record.

But a Liverpool side with five changes from the starting XI that beat AS Roma 5-2 in the Champions League semi-final, first leg at Anfield lacked their usual intensity and even Mo Salah fluffed a chance almost identical to one he buried in midweek.

Trent Alexander-Arnold, who was later substituted with a dead leg, also scuffed a shot on the six-yard line while Danny Ings had a goal disallowed for s marginal offside.

Despite enjoying 72 percent possession, Liverpool only had two shots on target and it was the first time since Dec. 26 that 43-goal Salah failed to score after starting a home game.

A dramatic finish saw Liverpool denied a penalty when Erik Pieters handled, while Stoke defender Ryan Shawcross almost snatched what would have been their first league win at Anfield.

Liverpool captain Jordan Henderson described the incident when the ball hit Pieters’ hand as a “blatant penalty”.

“For me it was a poor decision by the referee and linesman. They have ultimately cost us the three points,” said Henderson, who added that he should be okay for next week’s game at Roma despite receiving a kick on his calf in the first half.

Liverpool felt particularly aggrieved over the penalty after James Milner had conceded a spot kick in similar circumstances at home to Roma but Stoke midfielder Joe Allen said the visitors would have felt hard done by if it had been given.

Klopp said Liverpool had no new injury concerns for the Roma game. “We will be ready for Wednesday,” he said.

With Stoke’s relegation rivals playing later on Saturday, they are three points below the safety zone with two games left.

Huddersfield fretting after 2-0 home defeat by Everton

Huddersfield Town were left sweating over avoiding relegation after goals from Cenk Tosun and Idrissa Gueye condemned them to a 2-0 home defeat by mid-table Everton in a scrappy Premier League clash on Saturday.

The result left Huddersfield 16th on 35 points from as many games, two more than Swansea City – who are hosting Chelsea later on Saturday – and three ahead of 18th-placed Southampton who rekindled their survival hopes with a 2-1 home win over Bournemouth.

The home team’s boss David Wagner conceded his outfit were beaten by a better team and was optimistic about securing top flight football next season.

“The support from the stands was great, we gave everything but we were beaten by quality in the end,” Wagner told BBC.

“We missed opportunities and they scored with their first effort on goal and then in the second half we were not at the same level.

“We have to deal with it and we will deal with it. The players need a lift and we will give them that. We had good momentum. We will fight until the final end.”

Huddersfield dictated the pace in the opening half of a scrappy affair but Everton always looked more likely to break the deadlock. Tosun fired them ahead in the 39th minute with a fine finish from 18 metres after good work by Theo Walcott.

The visitors missed two good chances to double their advantage in the second half before Gueye silenced the noisy home crowd with a superb shot from 20 metres which gave the home keeper Jonas Loessl no chance.

Everton manager Sam Allardyce, who came under fire from the visiting fans, praised his team.

“It was an excellent performance,” he said.

“Huddersfield at home have been strong and they were looking to make themselves safe by beating us but we were too good for them.

“It’s a good win and that’s 11 points in six games. We are riding high and are finishing the season strongly… we shouldn’t keep talking about critics.”

Tadic answers Southampton’s prayers in Bournemouth win

Southampton’s Dusan Tadic kept alive their hopes of retaining their Premier League status by scoring twice in a 2-1 win over south-coast rivals Bournemouth to move them ahead of Stoke City in the battle to avoid the drop.

Mark Hughes recorded his first league victory as Southampton manager with his side showing fighting spirit at just the right time, moving to 32 points and within a point of the safety zone with three games left.

Serbian forward Tadic opened the scoring after 25 minutes with a clinical finish past goalkeeper Asmir Begovic before Bournemouth threatened to spoil the optimism when Joshua King netted an equaliser on the stroke of halftime

But Tadic ensured Southampton ended a dismal run of nine league matches without a victory at St Mary’s Stadium with the winner in the 54th minute when he raced onto a long ball and fired a low shot into the bottom corner.

It was a nervous start from both sides but Saints got the early advantage when they produced a superb counter-attack following a poor corner by Bournemouth and opened the scoring.

Nathan Redmond cleared the ball and Southampton had three on one as Mario Lemina burst forward and played the perfect ball into the path of Tadic who calmly slotted the ball past Begovic.

Charlie Austin and Lemina spurned chances to double the lead and Bournemouth made them pay at the end of the first half when King was left unmarked at the far post and directed the ball into the roof of the net from Ryan Fraser’s corner.

Saints had thrown away a two-goal lead against Arsenal in their previous home game but Tadic ensured there was no repeat performance as he netted the winner after 54 minutes.

Bournemouth defender Steve Cook failed to deal with a long pass forward from Alex McCarthy and Tadic reacted quickest as he picked up the loose ball and raced towards the penalty area before striking a left-foot shot into the bottom corner.

Eddie Howe’s Bournmeouth side had claims for a penalty turned down two minutes from time for a handball against Wesley Hoedt, while Southampton’s McCarthy made a fine save to keep out Fraser’s close-range effort in added time.

Southampton held on to record a priceless three points and will now be full of confidence as they prepare for their final three games against Everton, Swansea City and Manchester City.

Palace ease relegation fears with 5-0 rout of 10-man Leicester

Crystal Palace kept their Premier League survival hopes very much alive with a 5-0 thrashing of 10-man Leicester City, who had Marc Albrighton sent off in the 56th minute, at Selhurst Park on Saturday.

Wilfried Zaha put the hosts ahead with his fourth goal in four games from James McArthur’s backheel after both teams had cleared chances off the line – Kelechi Iheanacho from Palace’s James Tomkins and Joel Ward denying Leicester’s Jamie Vardy.

The pair combined again to put Palace two up before halftime, McArthur swivelling to shoot low into the bottom corner from a square ball by Zaha, who minutes earlier brought a diving save from Ben Hamer.

Leicester were on top just after the break but wilted after Albrighton was dismissed for bringing down Zaha, leaving Palace to wrap up the points with goals by Ruben Loftus-Cheek, Patrick van Aanholt and substitute Christian Benteke’s penalty.

Palace climbed to a season high of 11th in the standings with 38 points, six clear of the relegation zone with two matches to play. Leicester are ninth with 44.
